Individual purchases are licensed for the purchaser's personal preparation and may not be shared or redistributed.
Use Resources Responsibly
Elevate materials may be used for legitimate preparation, study, training, and authorized organization purposes.
Preparation, Not a Guarantee
Elevate supports exam preparation, but practice performance does not guarantee an official examination result.
1. Acceptance of These Terms
By accessing, purchasing from, creating an account with, or otherwise using Elevate Behavioral Learning websites, products, digital resources, member areas, or services, you agree to these Terms of Use.
If you do not agree to these Terms, you should not use Elevate products or services.
2. Elevate Services
Elevate Behavioral Learning provides educational exam-preparation resources that may include:
- RBT study guides and downloadable learning materials.
- Full-length and demonstration practice tests.
- Practice-test feedback and performance summaries.
- Individual Performance Profiles and learning analytics.
- Member dashboards and account-based resource access.
- Bundled preparation packages.
- Organization, team, cohort, or training-program access.
- Other educational resources or services Elevate may introduce in the future.
Product features, availability, pricing, and included resources may vary by purchase or membership.
3. Independent Exam-Preparation Resource
Elevate Behavioral Learning is an independent exam-preparation resource.
Elevate is not affiliated with, sponsored by, approved by, or endorsed by the Behavior Analyst Certification Board (BACB).
4. No Guarantee of Exam Results
Elevate products are designed to support preparation, practice, concept review, and identification of potential study needs.
Elevate does not guarantee that use of any study guide, practice test, bundle, dashboard, Performance Profile, organization program, or other resource will result in a passing score, certification, employment outcome, or other particular result.
Practice-test performance may differ from performance on an official examination.
5. Accounts and Access
Certain Elevate resources may require an account, membership, purchase, invitation, or other authorized access.
You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.
You agree not to:
- Share account credentials with unauthorized users.
- Provide another person with access to products purchased only for your individual use.
- Attempt to bypass a paywall, access restriction, entitlement, test limit, or other technical control.
- Use another person's account without authorization.
- Create accounts or transactions using false, misleading, or fraudulent information.
Elevate may restrict or suspend access when reasonably necessary to investigate suspected misuse, security concerns, payment issues, or violations of these Terms.
6. License to Use Elevate Materials
When you purchase or receive authorized access to an Elevate digital product, Elevate grants you a limited, non-exclusive, non-transferable, revocable license to use that material for the purpose associated with your purchase or authorized access.
Unless Elevate provides written permission, an individual purchase is for the purchaser's personal use only.
Purchasing a product does not transfer ownership of Elevate intellectual property to the purchaser.
7. Prohibited Sharing and Redistribution
Elevate materials may not be copied, uploaded, reproduced, distributed, sold, sublicensed, publicly posted, or shared with others except where expressly permitted by Elevate or applicable law.
This includes, without limitation:
- Study-guide files or substantial portions of study guides.
- Practice-test questions, answer choices, answer keys, explanations, or screenshots.
- Performance Profile content or protected dashboard content.
- Paid member resources.
- Organization resources outside the authorized learner, trainer, location, or cohort population.
- Copies of Elevate materials uploaded to shared drives, public websites, social platforms, repositories, question banks, or other distribution systems.
8. Practice Tests and Assessment Integrity
Elevate practice tests are proprietary educational preparation materials.
Users may not systematically reproduce, scrape, record, photograph, capture, extract, republish, sell, or build derivative question banks from Elevate practice-test content.
Users may not use automated tools, bots, scripts, or other extraction methods to collect questions, answer feedback, scoring information, or other protected test content.
9. Study Guides and Educational Content
Elevate makes reasonable efforts to provide clear and useful educational content. However, behavioral terminology, credentialing requirements, task lists, standards, exam structures, and related professional information may change over time.
Users remain responsible for reviewing current official credentialing requirements and authoritative source materials when making certification-related decisions.
10. Performance Profiles and Analytics
Elevate may organize practice-test performance into dashboards, section summaries, task-level results, progress trends, focus areas, or other analytics.
These tools are intended to help users interpret their Elevate practice activity. They are not official BACB examination reports and should not be interpreted as a guarantee or prediction of official examination performance.
11. Reported Exam Outcomes
Elevate may allow users or authorized organization users to report examination outcomes, attempt information, examination dates, or related performance information.
When outcome information is self-reported or submitted by an organization, Elevate may rely on the information provided and may not independently verify every submission.
Aggregated or de-identified outcome information may be used to improve Elevate products, evaluate preparation patterns, and develop analytics, subject to the Privacy Policy .
12. Organization Accounts and Purchases
ABA providers, employers, training programs, educational organizations, and other organizations may purchase or receive access for multiple learners.
Organization access may include learner assignments, cohort reporting, location or trainer segmentation, organization dashboards, purchasing tools, or other administrative features.
Organizations are responsible for ensuring that their authorized users use Elevate resources consistently with applicable law, internal policies, and any agreement with Elevate.
Additional written terms, quotes, order forms, pilot agreements, or purchasing agreements may apply to an organization purchase. If those terms conflict with these general Terms of Use, the specifically agreed written terms will control for that organization transaction to the extent of the conflict.
13. Purchases, Pricing, and Payment
Prices and product offerings displayed by Elevate may change from time to time.
You agree to provide accurate billing and payment information when making a purchase.
Payment processing may be handled by third-party payment providers. Elevate does not require users to send full payment-card information by email.
Any refund or purchase-review request is also subject to the Refund Policy .
14. Third-Party Platforms and Services
Elevate may use or integrate with third-party services for website hosting, payments, testing, email communication, analytics, authentication, data processing, or other business functions.
Your use of a third-party service may also be subject to that provider's terms or policies.
Elevate is not responsible for interruptions, limitations, or changes caused solely by an independent third-party service outside Elevate's reasonable control.
15. Intellectual Property
Elevate's original website content, study materials, practice questions, answer feedback, graphics, branding, logos, dashboards, layouts, written content, and other original materials are protected by applicable intellectual property laws.
Nothing in these Terms grants a user ownership of Elevate trademarks, copyrights, proprietary assessment content, software, designs, or other intellectual property.
References to third-party names, marks, terminology, or credentialing programs remain the property of their respective owners.
16. Acceptable Use
You agree not to use Elevate services in a way that:
- Violates applicable law.
- Infringes another person's intellectual property or privacy rights.
- Interferes with website, account, testing, or platform security.
- Attempts to gain unauthorized access to systems, accounts, databases, or restricted materials.
- Introduces malicious code or intentionally disrupts Elevate systems.
- Uses automated methods to extract, scrape, or replicate protected Elevate content.
- Misrepresents an affiliation with Elevate.
- Uses Elevate materials to create or commercially distribute an unauthorized competing copy of Elevate content.
17. Availability and Product Changes
Elevate may update, improve, replace, reorganize, or discontinue website features, content, dashboards, or products from time to time.
Elevate may also perform maintenance or temporarily limit access when reasonably necessary for security, updates, technical issues, or platform changes.
Where practical, Elevate will work to preserve access to purchased resources or provide a reasonable alternative when a material product change affects existing access.
18. Suspension or Termination of Access
Elevate may suspend, restrict, or terminate access when reasonably necessary because of:
- Material violation of these Terms.
- Unauthorized copying, sharing, or redistribution.
- Fraudulent or abusive account activity.
- Attempts to bypass access controls.
- Security threats or misuse of Elevate systems.
- Nonpayment or reversed payment where access was provided based on that payment.
Where appropriate, Elevate may contact the user and provide an opportunity to resolve an issue before permanent termination.
19. Disclaimer of Warranties
To the extent permitted by applicable law, Elevate products and services are provided on an "as available" basis for educational and exam-preparation purposes.
Elevate does not warrant that every product or service will be uninterrupted, error-free, or suitable for every user's individual preparation needs.
Nothing in this section limits rights or warranties that cannot lawfully be excluded.
20. Limitation of Liability
To the extent permitted by applicable law, Elevate Behavioral Learning will not be liable for indirect, incidental, special, consequential, or similar damages arising solely from use of or inability to use Elevate educational products or services.
Elevate is not responsible for decisions made by the BACB, testing providers, employers, educational institutions, licensing bodies, insurers, or other independent third parties.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
21. Privacy
Elevate's collection and use of personal information is described in the Privacy Policy .
Users should review that policy for information about account information, purchases, analytics, reported exam outcomes, organization data, and related data practices.
22. Governing Law
These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Any dispute concerning these Terms will be handled in a court or other forum of competent jurisdiction as permitted by applicable law.
23. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
24. Changes to These Terms
Elevate Behavioral Learning may update these Terms of Use from time to time as products, services, technologies, legal requirements, or business practices change.
The effective date displayed at the top of this page identifies the current version.
Continued use of Elevate after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
